Terms of Use
These Terms of Use (“Terms”) describe the terms and conditions under which Wageningen University and Stichting Wageningen Research (jointly: “WUR”) grants the user (“you”) the right to access and use the application programming interfaces (“APIs”) that are made available by WUR through the WFBR API Portal (“Portal”). Through registration and by accessing, downloading or otherwise using any APIs, you represent that you have read, understand, and agree to these Terms.
By registration through the Portal and by using the APIs, you represent that you have read and agree with WUR’s General Terms and Conditions for Electronic Goods and Services and WUR’s Privacy & Cookie Statement.
General Terms
In using the APIs, you acknowledge and agree that: (i) WUR is the owner or licensee of all intellectual property rights in the APIs and other material published on the Portal; (ii) WUR does not endorse, manage, oversee, control, take responsibility for, or make any representations or warranties for the use of the APIs; (iii) WUR makes no warranties and/or representations as to the timeliness, accuracy, completeness, reliability, correctness, availability, security, lack of defects/errors, lack of viruses/other harmful components, or overall quality of the APIs, or any other content, materials, documents, files, and other information either uploaded or downloaded on the Portal; and (iv) WUR shall not be liable (a) for any direct damages, or (b) for any lost profits or special, indirect, incidental, punitive, or consequential damages of any kind whatsoever, or (c) for any losses or damages to you, your affiliates/affiliated institutions, your service/API application, or anything else related to you, caused either in whole or in part by your use of the APIs and/or the Portal.
Use right
Subject to registration through the Portal and subject to the restrictions below, WUR grants to you a limited, revocable, non-exclusive, non-sublicensable, non-transferable license to access and use the APIs.
Restrictions
In using the APIs, you shall not: (i) make any commercial use of the APIs, or of the contents/results obtained by using the APIs; (ii) access or use the APIs for fraudulent or illegal purposes, or for any purpose that may be harmful to WUR; (iii) attempt to override, circumvent, or disable any encryption features or software protections of the APIs; (iv) display the name and/or logo of WUR in a manner that could reasonably imply an endorsement, relationship, or affiliation between you and WUR; and/or (v) undertake any activity that may interfere with, disrupt or otherwise burden the (availability of the) Portal and APIs.
Other provisions
These Terms can be adjusted by WUR without prior notice. Any updates are effective as soon as they are published on the Portal. Your continued access to and use of any APIs constitutes your acceptance of the then-current Terms. If you do not agree with any modifications to these Terms, your only recourse is to discontinue your use of any APIs and unsubscribe from the Portal.
WUR is entitled to terminate these Terms, and suspend or revoke your access to all or any of the APIs, at any time for any reason. When you receive notice from WUR, you will immediately stop using all APIs. You may terminate these Terms by discontinuing the use of the APIs.
Governing law and dispute resolution
These Terms are governed by laws of The Netherlands. Exclusive jurisdiction over and venue of any dispute arising out of or relating to these Terms will be in the District Court of Gelderland, The Netherlands.
